Appendix 1 - Right to Repair

The Right to Repair scheme gives residents the right to claim compensation if certain small urgent repairs are not carried out within prescribed time limits.  The right is granted to secure tenants under the Housing Act 1985, as amended by the Leasehold reform, Housing and Urban development Act 1993.  The right has been incorporated into our tenancy agreements and covers emergency or urgent repairs costing less than £250 that can jeopardise the health and safety or security of a resident.

If a qualifying repair is reported and then not carried out within the prescribed timescale (the first period) or without good reason, the resident can request that a second repair appointment is raised.

If the repair is not completed by the end of the second prescribed period then the resident will be entitled to compensation equal to £10 plus an additional £2 for each day’s delay in completing the repair up to a maximum of £50 total compensation.

The Right to Repair does not apply where the resident has told us that the repair is no longer wanted or where the resident has failed to make suitable access arrangements.

 

The Government suggested list of repairs which could be classified as Qualifying under the Right to Repair scheme is as follows:

  • Total or partial loss of electrical power.
  • Unsafe power, lighting socket or electrical fitting.
  • Total or partial loss of water, gas or oil supply.
  • Blocked flue to open fire or boiler.
  • Total or partial loss of space or water heating between 31st October and 1 May.
  • Blocked or leaking foul drain, soil stack or (where there is no other working toilet in the property) toilet pan.
  • Toilet not flushing (where there is no other toilet in the house).
  • Blocked sink, bath or basin.        
  • Leaking from water or heating pipe, tank or cistern.
  • Leaking roof.
  • Insecure external window, door or lock.
  • Loose or detached banister or handrail.
  • Rotten timber flooring or stair tread.

1) If we or our contractors fail to complete emergency or urgent repair works within the second timescale set. 

£10.00 one-off payment and £2.00 for each day the repair is not completed, (up to a maximum of £50.00).
